From the October 29th, 2007 meeting of the

Board of Directors of the Avalon Homeowners’ Association

 

 

The meeting was not called to order.  It started informally.

 

Board members not present:  Tony

Residents Present:  1 – Jon Powell – Retained Attorney

New Business:

 

¨       Jon Powell, the attorney that the Board retained, was present and the Board discussed several matters with him including the following:

 

1.       The Fine System that the Board has in place

·        Jon noted that the Board has the authority to charge fines to those who do not comply with covenants (Landscaping, Building Alterations, etc) in a timely manner.  He also noted that this ‘system” should be documented and advertised (newsletters, meetings, minutes, etc.)

 

2.       Mailbox Repairs

·        Jon noted that the board does have the right to compel residents to fix degrading mailboxes.  The current vehicle that the board operates under to effect these changes is sufficient and legal.  This vehicle includes notification and options for the repair.  Specifically, Jon indicated that it is legal for Charles to fix mailboxes so long as the Association bills and collects payments for this service.  The Association can then remit these payments to Charles.

 

3.       Rental houses

·        Jon noted that Rental Houses are not prohibited by the Covenants.  The covenants would have to be amended to place a prohibition on this activity.  The amendment could only be enforced on new owners (current owners did not buy their property subject to a rental restriction).

 

4.       Jon suggested that the retention ponds be posted with No Trespassing signage

 

5.       Jon reviewed an agreement presented to the Association by Landmark Homes.  This agreement essentially releases Landmark from certain legal bindings put into effect by the 2002 lawsuit between the Association and Landmark.  Jon indicated that the Board defer on signing the agreement until he could find out more about the situation.

 

 

6.       Jon indicated that a liability release be secured from residents who wished to use the common areas for the Association’s property.
